These terms of use ("Terms") govern your access to and use of the Prompt Refine website at promptrefine.com (the "Site") and any related services provided by Dappled Light, Inc. ("we" or "us"). By using or accessing the Site or any services, you agree to be bound by these Terms.

You must be at least 13 years old to access or use the Site or related services. If you are under 18, you may only use the Site and services with involvement and consent of a parent or legal guardian.

We grant you a limited, revocable, nonexclusive license to access and use the Site and services solely for your own personal use. Any use of the Site not expressly permitted by these Terms is prohibited.

All content on the Site, including but not limited to text, software, scripts, graphics, photos, sounds, videos, interactive features, and the like is owned by us, our licensors, or other third parties and is protected by copyright, trademark, patent, trade secret and other laws. We grant you no rights to such content.

You are solely responsible for any content you provide to the Site or services. You represent and warrant you have all rights needed to do so. We take no responsibility for your content. We have the right to remove or modify your content in our sole discretion. Please note that our LLMs may sometimes generate incorrect or misleading information. We cannot guarantee the LLM's responses will always be fully accurate. Use discretion when relying on any LLM-generated content.

You agree not to misuse the Site or services, such as by interfering with or disrupting them through viruses, bots, denial of service attacks, or other means. You agree not to attempt to access data or systems not intended for you. Violations may lead to termination of your access.

We are committed to protecting the privacy and security of your personal data in compliance with GDPR. You have the right to access, correct, delete, or request the transfer of your personal data. Please contact our Data Protection Officer (DPO) for any requests or concerns regarding your data. By using our services, you consent to the collection and use of your personal data as outlined in our Privacy Policy.

Certain services require payment of fees. Use of such services is subject to these Terms as well as any additional terms regarding the services. All fees are stated in US dollars and are non-refundable. We are not responsible for any issues regarding third party payment providers.

You can cancel your Pro or Plus account at any time by emailing [email protected] with your cancellation request. We will process account cancellation requests within 2-5 business days.

THE SERVICES AND CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE PAST YEAR. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO PARTS OF THIS LIMITATION MAY NOT APPLY.

We may modify these Terms from time to time and will post updated versions on this page. All modifications are effective upon posting. You are responsible for reviewing and becoming familiar with any modifications. Your continued use of the Site or services following the modifications constitutes your acceptance of them.

These Terms represent the entire agreement between you and us regarding the Site and services. The Terms include and incorporate our Privacy Policy. If any provision is found unenforceable, it will be severed while retaining the rest. The Terms are governed by United States law without regard to conflict of law rules. Any disputes shall be resolved exclusively in the federal or state courts in San Francisco, California.
